General terms and conditions (T&Cs)
These terms govern use of the Plenea platform by business customers (tenants — typically sports practices, performance centres, clinics or individual coaches).
1. Contracting parties
Michael Koller, Dr. Robert Fritz, Manfred Buxbaum und Tim Schneider (Alserstraße 27/6, 1080 Wien, Österreich; acting jointly under the Plenea brand, with a company being established — referred to below as “Plenea”) provide the SaaS platform. The “tenant” operates the platform for its own athletes and acts as their data controller under Article 4(7) GDPR. Plenea is the processor (Article 28 GDPR; a template data processing agreement is available, with binding acceptance in the app under Settings → Privacy).
2. Formation of the contract
The contract is formed by accepting an invitation that we issue following a demo request (trial), or by an individual agreement. Self-registration is currently unavailable. Trial accounts become read-only when the trial ends; their data is retained. A paid plan is activated by an explicit choice (or, until Stripe onboarding is complete, by an invoice sent by email).
3. Plans
- Trial — free for 30 days unless a different period has been agreed. After expiry, the account remains readable and new chargeable use is blocked.
- Free — no monthly base fee. Diagnostic tests and athletes with active plans are billed according to actual use.
- Solo — €89.00/month or €890.00/year excl. VAT, including 5 tests and 10 people with an active training plan. Additional usage is billed per unit.
- Practice Suite — €189.00/month or €1,890.00/year excl. VAT, including 25 tests and 30 people with an active training plan. Additional usage is billed per unit.
- Enterprise — integrations, service levels and terms by individual agreement.
The unit prices and included AI allowances for each plan are shown on the billing page before you subscribe. Additional AI credits are available in credit packs; if requested, they are purchased automatically, up to a monthly budget set by the tenant. Free is also activated through the billing page with a saved payment method (card or SEPA). Without a subscription with a payment method, chargeable use is unavailable after the trial. Usage is invoiced monthly in arrears, through Stripe once payment processing is enabled. The base fee may be paid monthly or annually; in both cases, the usage period remains the calendar month.
4. Services
Plenea provides the performance diagnostics, training planning, medical history, sports medicine and scheduling modules according to the agreed plan. The main application and database are hosted by Hetzner in Helsinki (EU); external AI and other services may process data outside the EU (see the sub-processor register). Database backups are made daily. Availability, recovery and support commitments (service levels) apply only where individually agreed.
5. Tenant obligations
- Keep contact details and the billing address up to date (under /settings).
- Obtain athlete consent to process health data (Article 9(2)(a) GDPR). Plenea provides a portal flow for this.
- Keep credentials confidential, particularly the admin account and API keys. Two-factor sign-in is available on every plan and may be required for the entire tenant.
- Notify Plenea immediately of data protection incidents (→ breach runbook, internal response time 24 hours).
6. AI use
All AI recommendations support decision-making and are not diagnoses. Human oversight varies with risk: outputs relevant to plans or medicine require approval by a coach or doctor before reaching the athlete; simple coaching replies and rule-based plan adjustments run without individual approval. Personal review of every output is not promised. The tenant may disable AI for its access. Personal AI features for athletes require their current explicit consent; withdrawal blocks new AI processing of their personal data.
7. Liability
Plenea is liable for intent and gross negligence. For slight negligence, liability is limited to essential contractual obligations, to foreseeable damage typical of the contract, and to a maximum of the fees paid during the previous 12 months. Liability for data loss is limited to the effort that would have been necessary with regular backups (daily backups; see the retention policy).
8. Termination and data export
Monthly base fees may be cancelled at the end of the current monthly period and annual base fees at the end of the current annual period (trials at any time). Upgrading to a higher plan or changing from monthly to annual payment takes effect immediately: the new base fee is charged pro rata from the change date and the previous fee is credited pro rata. Downgrading or changing from annual to monthly payment takes effect at the end of the paid period. Please export any data you need before the contract ends. A 30-day grace period follows, after which health data and associated files are deleted in full. There is no general pseudonymised diagnostics pool. Records hosted for your practice are also deleted after export. The platform retains its own invoices only to the extent specifically required and for a separate retention period. The amended contract wording is undergoing legal review.
9. Applicable law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Vienna.
